Earlier this month, the FTC issued a new policy statement regarding the prohibition on unfair methods of competition under Section 5 of the FTC Act. This statement, as Chair Khan emphasized, reverses the Commission’s position in recent decades, during which it either ignored or severely restricted its mandate to police such practices.
